Even after qualifying through TET and other competitive examinations and joining service as teachers or in various government departments, employees were forced by the state government to work on a fixed salary for five years. This policy had been in effect for nearly two and a half decades.
Challenging this policy, 18 employees filed an appeal against the state government in the High Court. Advocate Purushottam Roy Barman informed the media that the High Court finally delivered its verdict in this case on Thursday.
He further stated that in 2001 and 2007, the state government had taken decisions stating that even after joining government service under a regular pay scale, employees would be required to work on a fixed salary for five years. Only after completing five years on a fixed pay would they be brought under the regular pay scale. The Hon’ble Court declared both these rules unconstitutional and struck down the government orders.
The Court also directed that all those who had filed the writ petition must be treated as regular employees from the date of their appointment, and all pending arrears must be paid accordingly. In addition, the employees are to be paid interest at the rate of 9 percent, along with ₹2,000 each as litigation costs.
